1. Critical Trackside Safety & Liability Disclaimer
MOTORSPORT IS INHERENTLY DANGEROUS. Racing vehicles operate at extreme velocities and can eject debris, lose control, or breach barriers. By using Tracksider, you explicitly acknowledge and agree to the following terms:
- Track Marshal Authority: You MUST at all times obey official track marshals, safety stewards, and circuit security personnel. Marshal instructions strictly supersede any suggestions, photospots, walking paths, or advice shown in Tracksider.
- Red Zones & Prohibited Areas: Never enter restricted "Red Zones", hot run-off areas, gravel traps, or stand directly in the trajectory of impact barriers. Tracksider marks known Red Zones for safety awareness only; circuit boundaries may change dynamically during events.
- Credential Verification: Accessing media tabs, service roads, or pitlanes requires official accreditation issued by race sanctioning bodies (FIA, SRO, IMSA, ADAC, etc.) and circuit organizers. Tracksider does NOT grant, represent, or substitute for official media credentials.
2. Acceptance of Terms
By downloading, installing, accessing, or using the Tracksider mobile application or the tracksider.app website, you agree to be legally bound by these Terms of Service. If you do not agree to these terms, do not access or use the application.
3. Intellectual Property Rights
The Tracksider application, including its vector map styling, proprietary solar ephemeris algorithms, photographic databases, EXIF heuristics, logotypes, UI graphics, and software code, is the exclusive intellectual property of OMYY Media.
You are granted a limited, personal, non-exclusive, non-transferable, revocable license to use the app for personal and editorial trackside photography workflows. You may not reverse engineer, decompile, scrape, or commercially redistribute circuit coordinates, guides, or data without prior written permission.
4. "As Is" Warranty Disclaimer
Tracksider is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. While we endeavor to provide accurate circuit coordinates, sun angles, and spot guides, we make no guarantees regarding accuracy, timeliness, or uninterrupted availability.
5. Limitation of Liability
To the maximum extent permitted by applicable law, OMYY Media, its officers, employees, and partners shall not be held liable for any direct, indirect, incidental, special, or consequential damages resulting from:
- Personal injury, property loss, or equipment damage sustained at any race circuit or venue.
- Inaccuracies or dynamic changes in circuit layouts, weather telemetry, or sun angles.
- Denial of entry or revocation of credentials by race organizers.
6. Governing Law & Jurisdiction
These Terms of Service and any disputes arising out of or related to Tracksider shall be governed by and construed in accordance with the laws of Finland, without regard to its conflict of law principles. Any legal proceedings shall be submitted to the exclusive jurisdiction of the District Court of Helsinki, Finland.
